These Terms of Service govern your use of the erfa3ly platform.

erfa3ly is a deployment platform that provides:

  • Application deployment and hosting
  • Managed databases (MySQL, PostgreSQL, MongoDB)
  • Domain management and SSL certificates
  • Deployment monitoring and observability
  • Build and runtime management

3. Account Registration

3.1 Account Creation

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibility

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

3.3 Account Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent that you meet this requirement.

4. Acceptable Use

4.1 Permitted Use

You may use the Service for lawful purposes only, including:

  • Deploying web applications and APIs
  • Hosting websites and services
  • Managing databases and domains
  • Monitoring application performance

4.2 Prohibited Use

You agree NOT to use the Service for:

  • Illegal activities or content that violates any laws
  • Malware, viruses, or malicious code
  • Phishing, spam, or unsolicited communications
  • Cryptocurrency mining or similar resource-intensive activities
  • Proxy services or VPN endpoints
  • Content distribution networks (CDN) without prior approval
  • Activities that disrupt or harm the Service or other users
  • Circumventing usage limits or quotas

5. Intellectual Property

5.1 Your Content

You retain ownership of all content, code, and data you deploy to the Service ("Your Content"). You grant us a limited license to host, store, and process Your Content solely to provide the Service.

5.2 Our Content

The Service, including its design, features, and documentation, is owned by erfa3ly and protected by intellectual property laws. You may not copy, modify, or reverse engineer the Service.

6. Privacy and Data

Our collection and use of your personal data is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

7. Billing and Payments

7.1 Subscription Plans

The Service offers various subscription plans with different features and usage limits. You agree to pay all fees associated with your chosen plan.

7.2 Payment Terms

  • Fees are billed monthly or annually, depending on your plan
  • Payment is due at the start of each billing cycle
  • All fees are non-refundable unless otherwise stated
  • We may change pricing with 30 days' notice

7.3 Usage Limits and Throttling

Each plan has usage limits (deployments, concurrency, database storage). If you exceed these limits:

  • Soft throttling may be applied to reduce build speeds
  • You may be prompted to upgrade to a higher plan
  • Persistent excessive use may result in service suspension

7.4 Failed Payments

If payment fails, we will attempt to collect payment for up to 7 days. After that, your account may be suspended until payment is received.

8. Service Availability

8.1 Uptime

We strive to provide reliable service but do not guarantee 100% uptime. We are not liable for service interruptions due to maintenance, system failures, or circumstances beyond our control.

8.2 Maintenance

We may perform scheduled or emergency maintenance that temporarily affects service availability. We will provide advance notice when possible.

9. Data Backup and Recovery

9.1 Automated Backups

We provide automated daily backups for managed databases with 30-day retention. However, you are responsible for maintaining your own backups of critical data.

9.2 Data Loss

We are not liable for data loss or corruption. Use the Service at your own risk and maintain independent backups.

10. Security

10.1 Our Responsibilities

We implement security measures to protect the Service, including:

  • Encryption (TLS 1.3 in transit, AES-256 at rest)
  • Container isolation
  • Regular security updates
  • Vulnerability scanning

10.2 Your Responsibilities

You are responsible for:

  • Securing your account credentials
  • Keeping your application code secure
  • Managing access to your organization
  • Reporting security vulnerabilities to us

11. Suspension and Termination

11.1 Suspension

We may suspend your account if you:

  • Violate these Terms
  • Engage in prohibited activities
  • Fail to pay fees
  • Pose a security risk to the Service or other users

11.2 Termination by You

You may terminate your account at any time through the dashboard settings. Upon termination:

  • Access to the Service will cease immediately
  • Your deployments and data will be deleted within 30 days
  • No refunds will be issued for unused time

11.3 Termination by Us

We may terminate your account with 30 days' notice, or immediately for cause (violations, abuse, security threats).

12. Warranties and Disclaimers

12.1 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 No Guarantee

We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service will meet your specific requirements
  • Results obtained from the Service will be accurate or reliable

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERFA3LY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless erfa3ly from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your Content

15. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of Egypt. Any disputes shall be resolved in the courts of Egypt.

17. Dispute Resolution

Before filing a lawsuit, you agree to attempt to resolve disputes through good-faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or litigation.
